Section IV: Procedure
IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation
Extreme urgency brought about by events unforeseeable for the contracting authority and in accordance with the strict conditions stated in the directive.
Covid-19 is serious and its consequences pose a risk to life. Cabinet Office published PPN 01/20: responding to Covid-19 on procuring with extreme urgency in March 2020 which states that contracting authorities may enter into contracts without competing or advertising the requirement where certain tests are met:
1) Genuine reasons for extreme urgency existed as there is a significant public health risk requiring immediate action as a result of Covid-19;
2) Reacting to a current situation which was genuine emergency – not planning for one;
3) Covid-19 situation is novel and the contracting authority could not have reasonably foreseen these events;
4) It is not possible to comply with the timescales of another procedure due to the urgent requirement to obtain the equipment and PPE supplies being contracted for;
5) The contracting authority requirement for PPE could not be met by the national contracted supplier NHS Supply Chain or other contracted distributors, as they were unable to supply the required demand leaving the contracting authority in a position where they had to source direct to ensure security of supply;
6) The situation is not attributable to the contracting authority.
