The original title attributed to the contract by the Contracting Authority is Appointment of a Multi-disciplinary Team (MDT) for the Re-Development of the Palace Theatre.

This modification is to extend the contract duration relating to the Re-development Project for the Palace Theatre Site until 31st December 2023.

The original contract was for 40 months which appointed a lead MDT team on the development of the Palace Theatre Project (WEFO funded) the contract included RIBA Stage 1 to 7. The extension will be for additional 6 months, therefore the total contract period will be for 46 months.

VII.2.1) Description of the modifications

Swansea Council is issuing this transparency notice to alert economic operators of its plan to modify a contract in accordance with Regulation 72 (1) (b) of the Public Contracts Regulations 2015.

This modification extends the current contract duration by 6 months — Multi-Disciplinary Team Palace Theatre Redevelopment with GWP Architecture Ltd.

VII.2.2) Reasons for modification

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee

Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Need for additional works, services or supplies by the original contractor/concessionaire (Art. 43(1)(b) of Directive 2014/23/EU, Art. 72(1)(b) of Directive 2014/24/EU, Art. 89(1)(b) of Directive 2014/25/EU)

Description of the economic or technical reasons and the inconvenience and duplication of cost preventing a change of contractor:

The Contracting Authority is modifying this contract in accordance with Regulation 72(1)(b) the reasoning for this approach is that duplication of costs that would incurred due to the archaeological sensitivity of the site and the operational difficulties in having two contractors on this site. The modification is to extend the contract end date from 30th June 2023 to 31st December 2023. This requirement has occurred from the delay in engaging a contractor to undertake works at the site. The Palace Theatre is a historical building with many unforeseen archaeological factors, there has also been repercussions from COVID-19 which has caused set backs.
