Explanation
Bavarian Nordic is the sole manufacturer of Jynneos Vaccine. The contracting authority used the negotiated procedure without prior publication route to make a Direct Award on the basis of Regulation 32(2)(b)(iii) – justification for there being only one economic operator was the protection of exclusive rights (under Reg 32(2)(b)(iii))
