The Contracting Authority does not intend to include a sub-contract clause as part of community benefits (as per Section 25 of the Procurement Reform (Scotland) Act 2014) in this contract for the following reason:
The PIN responses stated that sub-contracting will not be required to fulfil the requirement. However, where appropriate it will be encouraged for suppliers to advertise any sub-contracting opportunities via PCS, however it will not be mandated. The use of PCS to advertise sub-contracting opportunities is not intended to cut across supply chain arrangements that the supplier may already have in place.
Where a Bidder relies on the capacities of other entities (i.e., subcontractors and/or consortium members) in order to meet the selection criteria, they must provide a separate SPD for each sub-contractor and/or consortium member.
The Contracting Authority does not intend to include any community benefit requirements in this contract for the following reason:
The Purchaser has considered the Community Benefits requirement of the Procurement Reform (Scotland) Act 2014, and has concluded that these shall not apply to this procurement.
However, the Purchaser is dedicated to the exploitation of Community Benefit opportunities when they arise. Accordingly, should the Bidder offer community benefits on a voluntary basis, they will be required to discuss the content of their community benefit proposal and agree a plan for the delivery of the agreed community benefits which will become a condition of the contract.
