VI.3) Additional information
This contract has been awarded under the urgent circumstances provision of the Provider Selection Regime (PSR). This contract has been awarded under the Health Care Services (Provider Selection Regime) Regulations 2023. For the avoidance of doubt, the provisions of the Public Contracts Regulations 2025 do not apply to this award.

Primarily this is to support timely and safe patient care and ensure that patients are reviewed and followed up within clinically set timeframes. Failure to do so represents a potential patient safety issue. The Trust does not have sufficient existing capacity to treat this cohort of new patients in clinically acceptable timeframes. The rationale for the urgent award relates to the cessation of the previous contract at which point there was still a large volume of patients requiring treatment. A contract must be put in place to ensure no safety issues occur and to maintain continuity of care.

The supplier has a track record of delivery for over 3 years, favourable rates for activity, dual visibility of patients and well-established processes for patient tracking. Utilising a different supplier at this point is not viable, as there would be a range of potential patient safety issues, primarily concerning continuation of care, clinical information sharing and timeliness of follow-up. Modality also offers a multitude of available sites offering patients choice and the ability to be seen closer to home. IT and Systems access are also well-established, again reducing any potential risk.

Conflicts of interest identified among the decision making group - None
