Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
No tenders or no suitable tenders/requests to participate in response to restricted procedure
Explanation
The Council followed a further competition process through Lot 3.2 of the CCS framework - Construction Works and Associated Services ref. RM. 6088 in compliance with the framework rules. However, following an expressions of interest and invitation to tender stage no bids were received.
Due to no bids being received it was decided to undertake a negotiated procedure without prior publication.
NB - in accordance with paragraph 5 (3) (b) of The Procurement Act 2023 (Commencement No. 3 and Transitional and Saving Provisions) Regulations 2024, as the ITT for the negotiated procedure was issued to the suppliers before 24 February 2025 when the Procurement Act 2023 came into force, Regulation 32 (2) (a) of the PCR2015 applies and not the relevant section of the Procurement Act 2023.
