The food pantries cater for vulnerable people including those in the justice system who have been referred by the Council, (upon consent of the individual), and help alleviate food poverty. Section IV: Procedure
IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation
This approach is considered justified and aligned to the Procurement Reform (Scotland) Act 2014, which states that Public Sector Organisations may award a contract without seeking offers, considering the principles of procurement where relevant. In this instance, there was no suitable supply market that the Council could access within the required timeframe. This method of award will mitigate the risk of a gap in delivery of the services, minimising the impact on the supported individuals. The approach also takes into consideration that a sudden change in provider would not allow for an effective transition which may be disruptive and damage the relationships that have been established with the individuals so far.
