Abstract

Carmarthenshire County Council is establishing a Framework for the delivery of domiciliary support services, including community intake, community support, complex care, replacement care services for adults living in the community and community assessment service.

The framework is intended to ensure the provision of high-quality, person-centred care that enables individuals to remain independent and safe at home.

The Authority may, in accordance with the flexibility afforded under the Light Touch Regime (Section 9, PA23), undertake a refresh of this Framework at one or more intervals during the Framework Term. The Authority will publish a Tender Notice for each refresh event, clearly setting out the requirements, evaluation methodology and timeline. Suppliers admitted through the refresh shall be appointed on the same substantive terms as existing Framework Suppliers. The refresh may include, but shall not be limited to, varying the number, scope, extent and description of the Lots, Services and/or Pricing (as the case may be), together with the appointment of additional (new) Suppliers onto the Framework Agreement to maintain market access and continuity of service.

Scope

Procurement description

Framework operation description

Call-off contracts under this Framework will be awarded by Direct Award only.

For each requirement, the Authority will identify the relevant Lot and approach the appointed Framework Supplier for that Lot or, where multiple suppliers are appointed, the highest-ranked Framework Supplier based on the scores achieved during the original Framework procurement process. If the supplier accepts the Authority's request to enter into a call-off contract, the parties will finalise and enter into the call-off agreement. Where a supplier declines the opportunity, fails to respond within two working days, or does not enter into a call-off contract within a time frame considered acceptable by the Authority, the Authority may approach the next-ranked supplier within the relevant Lot until a contract is awarded.

Call-off contract pricing will be based on the rates and pricing schedules set by the Authority within the Framework Agreement, or, for Lot 2 Complex Care, the rate submitted by the Tenderer.

The Authority reserves the right to invoke the user choice provisions applicable to Light Touch Contracts under the Procurement Act 2023 and the Framework Agreement where this is considered appropriate to meet an individual's assessed needs, preferences, outcomes, or statutory rights.
