Notification to Bidders under Reg. 24 Public Contracts Regulations 2015 re. abandonment of procurement exercise:

“I appreciate the patience and understanding you have shown during the last few weeks when we have had to extend the standstill period by seven weeks. The reason for those extensions was to give us time to consider information handed to us about the procurement process.

As you will know, the Authority is under an obligation to take appropriate measures to identify and prevent a conflict of interest in the procurement process. Unfortunately, having considered the information which has come to hand, it is possible that a member of staff involved in the process may have had a personal interest which might be perceived to compromise the impartiality and independence of the process. We do have strict policies and procedures in place to require appropriate declarations of interest to be made by staff. There was no way that the Authority could have been aware of or foreseen this potential conflict. I therefore regret to advise you that we have taken the decision not to award the contract. This is not a decision which we have taken lightly.

We wish to make it clear that we do not intend to implicate any tenderer.

We will now take time to re-assess our needs for the Country Park in order to inform any future procurement. I sincerely hope that you accept that our only aim is to ensure openness, transparency and equality of opportunity for all tenderers, and that you will not be deterred from dealing with us in the future”.
