Epping Forest District Council sought to commission consultants to provide technical support in the preparation of the Local Plan in order to undertake in October/November 2016 a consultation pursuant to Regulation 18 of the Town and Country Planning (Local Planning)(England) Regulations 2012. The two main areas of work were the undertaking of the site selection process and taking forward an associated infrastructure delivery plan. It is critical that this work is undertaken in conformity with the policy in the National Planning Policy Framework and Planning Practice Guidance and with the Government's regulations on Local Plans and that the work should take account of recent Inspectors' decisions and the Local Plan timetable.

IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation
The adoption of a new Local Plan is the Council's top Corporate Priority. The Government's expectation is that all authorities should have a Plan in place by Spring 2017 and intend to intervene to ensure compliance, including imposing sanctions in relation to loss of New Homes Bonus. The Council considered that a contract for technical support for delivery of its Plan would be a sub-threshold contract. The opportunity was accordingly advertised on ContractsFinder. Only one tender was submitted. Indicative costs for proposed stages of work in the tender were sub-threshold. Completion of stage 1 of the work revealed that further work was required. The timetable for completion of the Plan is extremely tight, and subject to financial penalties if not complied with. The draft plan has to be put out to consultation on 31 October if the Government's deadline is to be met. The contract has been modified as described in VI.3 above. The modification does not give rise to a new contract that requires a new procurement because one or more of the circumstances in Reg 72/32 of the PCR applies. The modification is not substantial (Reg 72(1)(e)) because it does not render the contract or its scope materially different to the one initially concluded; the modification would not have allowed for admission of other tenders or attracted other participants and does not change the economic balance in favour of the contractor. Although there is an impact on price this reflects the additional work required. Arup has designed a bespoke staged approach to the work required to deliver the Council's Plan by the deadline. A different contractor would take a different approach and would not therefore be able to pick up where Arup left off, leading to a risk that the timetable for the Plan would not be met. The Council was permitted (Reg 32(2)) to amend the contract in the way described because competition was absent for technical reasons and/or because the time limits for the open or restricted procedures or competitive procedure with negotiation could not have been complied with if the Council was to meet the Government-imposed deadline for adoption of a Plan. Meeting that deadline is a matter of extreme urgency in that missing it would lead to the loss of some or whole of the Council's New Homes Bonus with the consequential impact on Council finances and delivery of its services and the much needed homes to be built in the District.

Contract advertised for technical support for Council's Local Plan, Arup was only bidder. 2 areas of work were site selection process (SSP) and infrastructure delivery plan (IDP). Arup identified 6 stages for SSP and 3 for IDP. Stage 1 SSP and IDP priced at GBP 43 000. Indicative costs for stages 2-4 (SSP) and 2-3 (IDP) were GBP 70 000 and GBP 39 000. Later stages could not be priced at that stage. Council contracted with Arup to undertake stage 1. Contract commenced 7/4/16 and was due to expire 30/9/16. Stage 1 SSP found more work required in later stages of SSP/IDP than anticipated due to more sites being identified than assumed by the Council. Council and Arup agreed fee of GBP 323 272 for all remaining stages. On 4/11/16 Council and Arup amended the contract to cover all stages of SSP and IDP.
