This is an approved list of transport operators that will be commissioned via the council's web-based Dynamic Purchasing System (DPS). The approved list is open to any operator to join at any time, upon satisfying the entry criteria. More information is available at www.sproc.net. The Council is seeking to procure suitable transport provision that is safe, secure and reliable; to transport Children to and from school or other educational establishments, respite/short break provision or any other location where transport has been authorised by the council. A significant proportion of those children transported will be for children who have a wide variety of special needs including learning, physical or behavioural difficulties. The service may also include general ad-hoc taxi services as required. The estimated value is based on a total of 3 years of average expenditure, with individual contract values being subject to end user activity.

For the purposes of Regulation 72(1)(a) of the Public Contracts Regulations 2015, Milton Keynes Council anticipate that during the term of the DPS set up pursuant to this contract notice, additional services for adult social care transport will come into scope for provision under this DPS. The Council reserves the right to run tenders run tenders under the DPS for these additional services.

Economic operators are notified that Milton Keynes Council anticipates that the first tender under the DPS subject of this contract notice will be published on 5 February 2018. As a result, for the initial set up of the DPS, Milton Keynes Council is exercising the discretion granted under the Public Contracts Regulations 2015 to extend the period for evaluation of requests to participate following the publication of the contract notice. All requests to participate received from the date of the publication of the contract notice on 2 January 2018 will be evaluated by Milton Keynes Council on 14 January 2018 and economic operators who submit their request to participate by the said date will be notified of whether or not they have been admitted on to the DPS by 15 January 2018.

With regard to the award criteria, most contracts will be awarded on price but additional quality will be relevant to some requirements. Bids (where applicable) will be subject to pass/fail quality criteria. Only providers passing on quality, will be evaluated and ranked 100 % on price.

The Contracting Authority is not obliged to observe a standstill period in accordance with Regulation 87 of the Public Contracts Regulations 2015, in the initial admission of economic operators onto the DPS as no contract will be awarded at this stage. Any economic operator who submits a request to participate in the DPS and who has been sent a notice of being unsuccessful may write to the Contracting Authority through SPROC.NET or at the address given below to request further information. The Contracting Authority will, as appropriate and further having regard to applicable laws, provide any further information to the economic operator regarding its request to participate submission and the outcome.

The above is without prejudice to any remedies that are available to economic operators under the Public Contracts Regulations 2015 and other applicable law.

Economic operators are reminded that the Dynamic Purchasing System will remain open during its term of 2 years with a possible 1 year extension and in the event that they do not succeed on getting onto the DPS in the first instance, they can apply at any time during the validity of the DPS to be admitted on to the DPS. Such admission will be subject to meeting the requirements set by the Contracting Authority for admission of economic operators to participate in the Dynamic Purchasing System.
