Section IV: Procedure
IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation
The Short Range Air Defence (SHORAD) Project Team, part of the UK Ministry of Defence, proposes to let an amendment to extend contract SHORAD/0003 for the In Service Support of the Seawolf Point defence Missile system with BAE Systems. The duration of the existing contract will be extended for 15 months for support from 1.2018 until 3.2019 and subsequent disposal activities taking place from 3.2019 to 2022.
Lt is considered that this contract can be placed using the negotiated procedure without prior publication pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011). This is due to technical reasons whereby BAE Systems is the only economic operator in the market able to provide the required level of expertise and support to the requirement.
BAE Systems are the Design Authority for Seawolf Tracking and Guidance Sub-system (TGSS) and Seawolf mid Life update and are therefore uniquely placed to support the weapon system, having designed, certificated and supported the system throughout its service life. The technical expertise within BAE Systems is key to the continued safety certification and maintenance of the system, ensuring a continued Point Defence Missile System capability onboard the Royal Navy Type 23 Frigates. Failure to implement suitable support would jeopardise the functionality of these platforms and subsequently the safety of deployed personnel. BAE Systems are the only organisation suitably qualified and experienced to provide the required level of support, as well as offering an acceptable level of risk to the safety and maintenance of the capability.
