IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation
The contracting authority’s SCRIM was purchased from WDM Ltd. WDM® is the sole manufacturer worldwide of the SCRIM®, working under license to the UK Transport Research Laboratory (TRL) and is therefore the only company who can carry out the repairs/upgrade to the on-board operating system, compatible with the British Standard.
Regulation 32 (5) (b) of the Public Contract Regulations 2015 enables the Department to negotiate a contract directly with 1 or more economic operators, where a change of supplier would oblige the contracting authority to acquire supplies having different technical characteristics, which would result in incompatibility or disproportionate technical difficulties in operation and maintenance.
