The procurement falls outside the scope of application of the Directive
Explanation
Modification of a contract under Public Contract regulations 2015 Regulation 72 where the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen. Due to the restrictions imposed due to the Covid pandemic the Council has been restricting visits to indoor spaces in order to protect staff, the nature of this tender would generally require site visits from multiple parties in order to ascertain the service that has to be provided, under the circumstances earlier in the pandemic the Council felt it was not appropriate to allow these to be undertaken. The contract modification will extend the contract to the end of December 2021 in order for a new procurement to be undertaken within these timescales.
