The University already has a 2 years extension option from the original procurement, which it intends to utilise from 1.8.2018 to 31.7.2020. The University has negotiated a further 3 years extension beyond the originally envisaged 7 years contract to 31.7.2023 as this allows the University to achieve this upgrade without capital outlay.

The value attributed to the proposed arrangements from 1.8.2020 to 31.7.2023 is based upon the service management fee which includes the amortisation of the capital cost across the contract extension period.

Additional deliveries by the original supplier ordered under the strict conditions stated in the Directive

Explanation:

The proposed arrangements fall within regulation 72(1)(c) of the public contracts Regulations 2015 on the basis that the contract modification has been brought about by circumstances that the University could not have foreseen, the technology used in student devices and the number of personal devices per student has grown and developed beyond what was available and forecast at the time of contract award. The services supplied under the extension do not alter the overall nature of the contract and the increase does not exceed 50 % of the original contract value.

Further, or in the alternative, the proposed arrangements fall within regulation 32(2)(a) of the public contracts Regulations 2015 on the basis that the University held market testing events in Dec 2017 following publication of a PIN, no suitable alternative to the selected partner expressed an interest in taking part in the exercise or was identified due to the technical ability required to fulfil the contract.

Further, or in the alternative, the proposed arrangements fall within regulation 32(5)(b) of the public contracts Regulations 2015 on the basis that the technical upgrade by another supplier would result in disproportionate technical difficulties in operation and maintenance.
