II.2.4) Description of the procurement
The Council has a licence to use "Northgate" Software — a package of modules for Housing Management (to include Estates & Rents Allocations, Homelessness, Repairs, Planned Maintenance, House Purchase, Contractors System, Works Orders and Service Charges) and Revenues & Benefits (to include Council Tax, Housing and Council Tax Benefits, IB/SEA, Local Housing Allowance, Scan Applications, Work Flows, Landlords Portal, PMQA and SPA Manager) along with Auddis & Addacs, and Integrators for both systems — that has been in place since 1998 as a result of a competitive tender. A 5 year contract has been awarded to continue use of the same software in a hosted environment.

The works, supplies or services can be provided only by a particular economic operator for the following reason: protection of exclusive rights, including intellectual property rights
Explanation
The Council has an existing agreement for the provision of software that has been in place since 1998 following a competitive procedure under the relevant legislation at that time. Following a review, the Council has concluded it does not have the finances available to invest in a completely new software system that has a significant and strategic use across the organisation and therefore needs to retain the current software, the intellectual property of which is owned by Northgate Public Service (UK) Limited who licence the software for use by the Council. To allow for modern working practices the software is to be hosted by Northgate.
