Abstract

An existing contract provides for the administration of childcare vouchers. Whilst this scheme is closed to new entrants we need a solution for those with ‘grandfather’ rights who can remain in the scheme until they no longer meet the criteria as defined by HMRC. The intention is to award this contract to the incumbent for continuity for employees who already hold childcare voucher online accounts with them and their childcare providers. A change of overall system at the current time would have a major impact on employees and their childcare providers, and require costs of change for the Council and other potential service providers which the latter would be unlikely to pursue i.e. we believe other providers would be interested now the existing arrangements will rapidly decrease in value.

The Council intends the new contract to commence from 1.4.2019 and expire by 31.3.2029 (expiry expected of any remaining ‘grandfather’ rights) with no options to extend permitted via this contract; should legislation revert or otherwise change with an opportunity returning for new entrants via a Council managed contract, the Council would look to re-procure this through competition.

The procurement falls outside the scope of application of the Directive

Explanation:

The Council believes that there will be an absence of competition for technical reasons. The services can be provided by the particular economic operator already providing them to the Council employees, unless an alternative provider and the Council both want or need to cover costs of change for a service that will be decreasing in value year or year until no longer required.
