The UK MOD is undertaking research and development of an autonomous man overboard recovery system to reduce risk of life in hazardous maritime environments. As part of the development of the system the UK MOD intends to contract Malloy Aeronautics Ltd to undertake integration and test facilitation activities on an authority-owned Malloy TRV-80 Unmanned Air System. This procurement will be conducted as a negotiated procedure without prior publication under PCR 2015 Regulation 32(2)(b)(iii) due to Malloy Aeronautic Ltd's exclusive rights as the original equipment manufacturer. The authority does not commit itself to any future single source purchases based on the results of this procurement.

Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: protection of exclusive rights, including intellectual property rights
Explanation:
The Minerva project is an attempt to prove that the concept of an autonomous man overboard recovery system is feasible using current technology. As part of proving the feasibility of such a system, the UK MOD intends to contract Malloy Aeronautics Ltd to undertake modifications to an authority-owned Malloy TRV-80 Unmanned Air System to enable it to carry a lifeboat, integrate third-party software and hardware to enable identification of a man overboard and autonomous take-off and landing at sea and facilitate testing of the system. Malloy Aeronautics Ltd has exclusive rights as the original equipment manufacturer for the TRV-80. Once the concept is proven feasible then the authority intends to run an open competition for the procurement of a Minerva system.
