The procurement falls outside the scope of application of the Directive
Explanation
This Call-off contract is required as a result of National Highways requiring an examination of the CHARM Service Outage Incident of 26/27-Oct-21, why this Service Outage occurred and what remediation is needed to prevent a reoccurrence. Within that context, the Relevant Service in question is required to be done promptly and establishing this direct contractual arrangement will allow the deliverables to be acheived.
