Abstract

STFC have procured the manufacture of the Quantum Electron Microscopy (QEM) 2 sensor for supply to a consortium of international academic and commercial organisations. This sensor was designed at STFC and will be manufactured at an Integrated Circuit fabrication plant (“fab”).

Having investigated the sourcing options, there was no competition available to meet the requirement, this was due to the fact that using a different “fab” would result in a sensor with different technical characteristics which would result in incompatibility and disproportionate difficulties in operation and maintenance technical difficulties.

It was therefore approved that a single sourcing action was appropriate.

Section IV: Procedure

IV.1) Description

IV.1.1) Type of procedure

Award of a contract without prior publication of a call for competition

Justification for selected award procedure:

The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons

Explanation

Due to Etesian Semiconductor Limited owning the IPR for the manufacturing process for the QEM 2 sensor, this makes them the only supplier for this project.

The QEM2 sensor design contains circuitry previously manufactured using the Etesian Semiconductor Limited process. This was tested by STFC and its performance met the requirements to proceed with the QEM2 design. This performance is strongly linked to the manufacturing process which can only be provided by this supplier.

The Public Contract Regulations 2015 make provision for this contract to be placed under regulation 32 (5)(b) which is for additional deliveries by the original supplier, which in this case are intended as an extension of existing supplies or installations where a change of supplier would oblige the Contracting Authority to acquire supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance.

In addition, Etesian Semiconductor Limited own the IPR for the manufacturing process which will produce the identical chips that are required in order to deliver this project (PCR 32 (2)(b)(iii)).
