Explanation
It is considered that the award of a new contract in the circumstances detailed in this Paper is consistent with Regulations 33 (1) (b) (ii) and (iii) of the Public Contracts (Scotland) Regulations 2015, which allow the Contracting Authority to award a contract without a competitive process when for technical reasons or for reasons connected with the protection of exclusive rights, including intellectual property rights, a public contract may be awarded only to a particular economic operator. Experian Ltd is the owner of the systems software and therefore the only entity that can license and provide support and maintenance services for the systems, with Northgate Public Services being its only licensed reseller.
