The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation
The Vehicle Support Team — Armoured Tracks Portfolio (‘VST-ATP’), part of the UK Ministry of Defence (‘MOD’), intends to let a new contract with Cummins for the Redesign of the AS90 Cooling Group.
It is considered that this contract will be let using the negotiated procedure without prior publication of a contract notice in accordance with Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011) for technical reasons.
The AS90 is an armoured self-propelled artillery platform. Cummins are the design authority for the power pack and the original equipment manufacturer for the engine. As such, they have access to the background technical information and in-depth knowledge of the whole power pack system, the cooling group requirements and interfaces. This enables Cummins to redesign the cooling group without introducing disproportionate risks to the safe functioning and operation of the MOD’s vehicles.
