The works, supplies or services can be provided only by a particular economic operator for the following reason: protection of exclusive rights, including intellectual property rights
Explanation
Award a contract directly as this approach is allowed under the UCR's where restrictions on the use of IPR do not trigger a requirement to conduct a new OJEU-compliant tender process. We believe in this circumstance the following is applicable:
There are grounds where NTL as public body could modify a contract with a third party using the exemptions in Regulation 88 of the UCR. This exemption is provided for under the following UCR Regulation:
88.-(1) Contracts and framework agreements may be modified without a new procurement procedure in accordance with these Regulations based on the following:
(b) for additional works, services or supplies by the original contractor, irrespective of their value, that have become necessary and were not included in the initial procurement where a change of contractor:
(i) cannot be made for economic or technical reasons such as requirements of interchangeability or interoperability with existing equipment, software, services or installations procured under the initial procurement; and
(ii) would cause significant inconvenience or substantial duplication of costs for the utility.
The absence of competition is not the result of an artificial narrowing down of the parameters of the procurement.
