Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation:
The Trust operates from 2 sites: Broadmoor Hospital — Crowthorne, Berkshire RG45 7EG (‘Broadmoor’) and St Bernard's Hospital, Uxbridge Road London UB1 3EU (‘Ealing’). Following a fully advertised process (OJEU ref 2012/S 135-224884) the Trust appointed, in January 2014, Kier Construction Limited, to complete the design and construction of a high secure mental health facility providing approximately 160 mental health beds along with supporting facilities on the Broadmoor site (‘the Broadmoor Redevelopment Contract’) (OJEU ref 2014/S 012-016210). The Broadmoor Development Contract aims to utilise leading edge technology and best practice and to be regarded as a centre of clinical excellence. The Trust operates a unique NHS environment which has essential requirements relating to security measures and protocols.
An element of the Broadmoor Redevelopment Contract is for the supply and maintenance of a telephony service on that site. Kier Construction Limited has sub-contracted that element of the Broadmoor Redevelopment Contract to Telent Technology Services Limited.
Due to the nature of the services provided by the Trust, which involves the care in a secure setting of extremely vulnerable individuals, it is essential that communication systems in use on the Trust's sites are fully secure and compatible. In order to ensure that these essential requirements are met the Trust intends to replace the telephony service currently in place on the Ealing site with a service provided by Telent.
Due to its essential requirements for compatibility and security of communication across its sites, the telephony service on both the Broadmoor and Ealing sites can for technical reasons only be supplied by the same contractor.
The Trust therefore requires the supply and maintenance of telephony on the Ealing site to be delivered by the same contractor who has been sub-contracted to provide telephony on the Broadmoor site. For telephony to be delivered by different suppliers on each site would result in incompatibility and/or disproportionate technical difficulties in operation and maintenance, given the Trust's essential need for compatibility and security of its communication systems.
The Trust therefore intends to enter into a contract with Telent Technology Limited for the supply and maintenance of telephony at the Ealing site. The anticipated duration of that contract is 3 years.
