The contracting authority considers that this contract may be suitable for economic operators that are small or medium enterprises (SMEs). However, any selection of tenderers will be based solely on the criteria set out for the procurement.
An important element of this Contract is the reference to the Public Services (Social Value) Act 2012. This is an important Contract for the Council and it will be a requirement for the successful tenderer(s)/contractors (if any contract awarded) to consider how the Services they provide might improve the economic, social and environmental wellbeing of the area.
The procurement process is an open procedure, in accordance with the Public Contracts Regulations 2015. As part of this process, pre-procurement market engagement was undertaken to assist the Council to determine future requirements for the Services. The market engagement documentation is included in the procurement documentation.
The Council, having discussed it with the incumbent service provider, considers that the Transfer of Undertakings (Protection of Employment) Regulations 2006 as amended from time to time (TUPE) does not apply to this Contract(s). However, tenders should note that the Council is not the employer of any staff in question and tenderers must do their own due diligence to satisfy themselves as to its application or otherwise.
Tenderers should be aware that there will inevitably be continual pressure on public sector budgets over the period of any Contract awarded. The Council reserves the right to change the budget prior to and/or following award of the Contract(s) and does not guarantee any quantities detailed in the Service Profile and Specification or procurement documentation.
Tenderers should note consideration may be given during the contract period to the omission of some of the services or inclusion of additional services or options for additional services which are related to and will assist in delivering the Services.
It should be noted that in addition to any change in the structure or identity of the Contracting Authorities in the event of re-structuring within local government and or any other situation resulting in the Contracting Authorities or either of the Contracting Authorities having a successor to its (statutory) functions in respect of waste, recycling, treatment and or disposal this procurement and or the remaining term of the contract awarded will be passed to the said successor(s).
The Council reserves the right to amend any documentation throughout the procurement process, any changes made to the documentation will be declared through the Delta-esourcing.
The Council reserves the right to award more than one contract, no contract at all or to change the procurement process from time to time, and should they do so, will issue instructions to all tenderers. The procurement process commences by the publication of this notice and, in no circumstances the Council will be liable for any costs incurred by tenderers during the procurement process. The Council reserve the tight to cancel their participation in this procurement process at anytime to contract award without the risk of challenge.
