The CCTV system is a surveillance system that is required for our Safer communities service. This contract is for the maintenance and support of our current CCTV system. The original contract was due to expire on 31.8.2018. Although there are other CCTV system providers available, the maintenance for our current system can only be provided by the incumbent supplier. The continued maintenance of our current system is essential while we cover a vital period of service transformation in preparation for a move in hosting site location. During the service transformation review, an alternative digital CCTV solution will be sought to replace the current CCTV system.

Explanation:

This VEAT Notice is published under the Public Contract Regulations 2015. The procurement is for the maintenance and support of a specific CCTV system. While other systems exist the maintenance and support for the current system can only be provided by a single supplier who owns and operates the system. As per WDCs code of procurement practice, and an exemption was granted based on the premise that it is an IT commodity items where the maintenance and support is restricted to the original supplier.

For a price of 136 000 GBP, WDC is able to obtain maintenance and support for their CCTV system for 2 years to cover a vital period of service transformation in preparation for a move of the hosting CCTV site. During this period, an alternative digital CCTV solution will be sought to replace the current CCTV system. For these reasons, WDC is publishing this VEAT Notice as it believes that this maintenance and support service is only able to be provided by the current supplier ADT Fire and Security. WDC, therefore, intend to award a contract to ADT Fire and Security for 2 years commencing 1.9.2018.

Following the publication of the VEAT notice on 23.7.2018, there will be a 10 day standstill period, concluding on 2.7.2018.

Following a satisfactory conclusion of the standstill period, we will enter into a contract with ADT Fire and Security from 1.9.2018 for 2 years.

If an appeal regarding the award of a contract has not been successfully resolved, The Public Contract Regulation 2015 provide for aggrieved parties who have been harmed or at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Where a contract has not been entered into the Court may order the setting aside of the award decision or order the council to amend any document and may award damages. If the contract has been entered into the Court may only award damages.
