Extreme urgency brought about by events unforeseeable for the contracting authority and in accordance with the strict conditions stated in the Directive
Explanation
This Contract falls within the category of contracts covered by Regulation 74 of The Public Contracts (Scotland) Regulations 2015 and is being awarded in accordance with the process set out in Regulation 33, in particular Regulation 33 (1) section (c) "reasons of extreme urgency brought about by events unforeseen by the contracting authority, the time limits for open procedure, restricted procedure or competitive procedure with negotiation cannot be applied". Due to the unforeseen need to cancel the previous contract awarded on notice 502412, there was not the time to develop a new tender with appropriate lessons learned and coproduction with children/young people with disabilities and their carers who deem this service to be a life line as many cannot access main stream provision. The Council put in place emergency measures to ensure the continuation of the service for vulnerable families and awarded an interim contract to a provider with the knowledge and resource to provide support to the Council. This Council are currently reviewing the service requirements as part of a strategic process which is evaluating in-house disabilities services as a whole for children/young people. All interested providers who noted interest in PIN notice have been kept updated.
