The procurement falls outside the scope of application of the Directive
Explanation
Maryhill Housing Association's current contract was due to expire on 31 March 2021 and the Association had commenced a new procurement exercise. However the association's existing service provider issued a 13 week termination notice in April 2020-the existing contract will now terminate on 15 July 2020. Given the associations requirement to provide continuous services beyond this date there was insufficient time to conduct a full OJEU tender process, appoint a new provider, TUPE transfer existing employees and establish the required IT interfaces.
