Section IV: Procedure
IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
No tenders or no suitable tenders/requests to participate in response to open procedure
Explanation
There is an enduring requirement for ground fuels to support forces in Germany and the tender process led by the NSPA on behalf of Defence resulted in a failed competition. Regulation 32 (2) (a) of the Public Contracts Regulations 2015 allows for negotiation without prior publication, where there are no suitable tenders (the outcome of the competition did not meet the Defence Statement of Requirement). The short-term strategy is to negotiate directly a 12-month contract with Wilhelm Hoyer. A full project under PCR 15 will be competed by the Defence Fuels team to implement a long-term contract that meets the requirements of Defence.
