II.2.4) Description of the procurement

North Ayrshire Council (NAC) is responsible for the ongoing management and maintenance of a range of Sustainable Urban Drainage Systems (SuDS) assets located across the region. These assets include above-ground drainage features such as permeable paving, ponds, wetlands, detention basins, filter drains and associated infrastructure.

SuDS play a critical role in managing surface water runoff, reducing flood risk, improving water quality and supporting biodiversity. While certain drainage infrastructure is adopted and maintained by Scottish Water, NAC retains responsibility for maintaining a number of SuDS assets that do not form part of the public drainage network.

Following a review of the contract requirements, NAC is seeking to appoint a suitably qualified and experienced Contractor to provide inspection, maintenance and repair services for selected SuDS assets located throughout North Ayrshire. The revised procurement reflects an updated site list and current anticipated maintenance requirements.

The Contract will operate as a Measured Term Contract (MTC) on a call-off basis. Works will be instructed by NAC in accordance with operational requirements, site conditions and available budgets throughout the Contract period.

The Contract will be awarded under the SBCC Measured Term Contract for use in Scotland 2019 Edition (MTC/Scot), as supplemented by the Preliminaries and other Contract Documents issued as part of this procurement.

The initial Contract Period will be three (3) years with the option, at NAC's sole discretion and subject to satisfactory performance and funding, to extend the Contract by up to a further one (1) year.

III.1) Conditions for participation

III.1.1) Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers

If required, bidders are required to be enrolled in the relevant professional or trade registers within the country in which they are established.

Where it is required, within a bidder’s country of establishment they must confirm which authorisation or memberships of the relevant organisation(s) are required in order to perform this service.

III.1.2) Economic and financial standing

List and brief description of selection criteria:

Bidders will be required to have a minimum “general” yearly turnover of 100,000 GBP per year for the last 3 years.

North Ayrshire Council reserve the right to review the bidder's financial information using company watch financial analytics at tender stage and throughout the life of the contract. If this information or the clarifications are not satisfactory, the bidder will be excluded from the tender process.

Bidders who cannot meet the required level of turnover will be excluded from this tender.

Where turnover information is not available for the time period requested, the bidder will be required to state the date which they were set up or started trading.

It is a requirement of this contract that bidders hold, or can commit to obtain prior to the commencement of any subsequently awarded contract, the types and levels of insurance indicated below:

* Employers Liability Insurance = 10million GBP in respect of any one event

* Public Liability Insurance = 10million GBP in respect of any one event

* Third-party motor vehicle insurance - A valid motor vehicle certificate must be held in the company name or (where there is no fleet but rather the company permits its employees to use their personal vehicles for business purposes), a letter signed by a person of appropriate authority - confirming that the company has ongoing arrangements in place to ensure their employees' vehicles are appropriately insured and maintained.

Notes:

* The Contractor remains responsible for insuring their own plant, tools, equipment and temporary buildings, as the Employer provides no such cover.

* The Contractor shall bear the first 2,500 GBP of each and every claim, as stated in the Preliminaries.

III.1.3) Technical and professional ability

List and brief description of selection criteria:

Bidders must provide two examples that demonstrates they have the relevant experience to deliver the contract, as described in part II.2.4 of the Contract Notice. Examples must be of a similar scope, size and be from within the last three years. Unsatisfactory experience will result in a fail and exclusion from the tender process. If you submit more than two examples, NAC will only evaluate the first two examples provided.

Bidders must also provide two satisfactory references for the same two contracts. References should be fully completed and signed by previous customers and must be of a similar scope, size and be from within the last three years. If any of the referees score less than two, the bidder will be excluded from the tender process. If you submit more than two references, NAC will only evaluate the first two references provided.

Bidders should complete a separate experience / reference template for each experience example. Bidders should complete Section 1 Experience and then forward to the relevant customer/client to complete Section 2 Reference Proforma. The customer/client should return the completed template to the bidder and the bidder in turn will upload the fully completed template.

Bidders will be required to confirm whether they intend to subcontract and, if so, for what proportion of the contract.

Bidders who intend to subcontract more than 25% to any individual organisation must ensure the SPD (Scotland) - Subcontractors Supplier Response is completed and uploaded at question 2D.1.2 of the qualification envelope.

It is anticipated that the requirement for inspection, maintenance and repair services for Sustainable Urban Drainage Systems (SuDS) will continue beyond the term of this Contract. NAC may therefore undertake a future procurement exercise for similar services. Subject to business requirements, a further procurement exercise may be undertaken during 2030 in advance of the expiry of the Contract.

Quality Management Procedures

The bidder must hold a UKAS (or equivalent) accredited independent third-party certificate of compliance in accordance with BS EN ISO 9001 (or equivalent) or a documented policy regarding quality management.

Health and Safety Procedures

The bidder must hold a UKAS (or equivalent) accredited independent third-party certificate of compliance in accordance with ISO 45001 (or equivalent) or have, within the last 12 months, successfully met the assessment requirements of a construction-related scheme in registered membership of the Safety Schemes in Procurement (SSIP) forum or the bidder must have a regularly reviewed and documented policy for health and safety management.

Environmental Management Procedures

The bidder must hold a UKAS (or equivalent) accredited independent third-party certificate of compliance in accordance with BS EN ISO 14001 (or equivalent) or a valid EMAS (or equivalent) certificate or the bidder must have a regularly reviewed documented policy regarding environmental management, see attachment at SPD question 4D.2.
