II.1.4) Short description

Forensic care is specialised care and support provided to individuals involved with the criminal justice system, particularly those with mental health conditions, learning and physical disabilities aimed at reducing risk of offending, or re-offending, and harm to others. This type of care and support includes risk management, supervision and community support with an aim of improving mental health outcomes while reducing the likelihood of criminal behaviour.

III.1.1) Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers

List and brief description of conditions:

Where required, contracts that fall within the specific risk sectors as defined by Police Scotland, or, where there is a suspicion that risk may be present, WLC will provide Police Scotland information on the representatives of the bidder (SPD Part 2B) to allow Police Scotland to review and provide feedback on information provided.

Please note: when completing SPD section 1.12 Part 2B, this should be completed using personal information as follows: your full name including any middle names as it appears on your birth and/or marriage certificate; the day date and month you were born and the location of your birth; and your home address and postcode. The name entered must be consistent with any birth certificate, marriage certificate etc. Failure to provide the correct information may result in your bid being excluded from the tender process or an offer of contract being withdrawn should the information prove to be incomplete or incorrect at a later stage.

III.1.2) Economic and financial standing

List and brief description of selection criteria:

Re SPD question 4B.6 West Lothian Council will use Dun and Bradstreet’s DBAi financial reporting system to assess the financial stability of tenderers. Tenderers with a Failure Score of 50 or above on the DBAi system will be deemed to have evidenced satisfactory financial stability. Please note that 49 or less will not be considered as having met this criteria. If a tenderer has a Failure Score of less than 50, the tenderer will be required to submit their last three years accounts.

In the event that the tenderer is not required to publish accounts and therefore does not have a Dun & Bradstreet or equivalent rating, tenderers should be able to provide financial accounts when requested. The council will then conduct an analysis of the accounts to ensure that there is no significant financial risk. Please note that if you intend on attaching 2 years accounts, these must include financial data over a 3-year period.

It is recommended that candidates review their own Dun & Bradstreet Score in advance of submitting their tender. If following this review tenderers consider that the Dun & Bradstreet Score does not reflect their current financial status, details of this should be provided, complete with evidence of a good high street credit rating (the equivalent of Dun & Bradstreet score 50) from a recognised credit referencing agency. The council will review any such information as part of the evaluation of Tenderer’s financial status.

In the event that a firm does not meet the financial criteria for consideration but has a parent company that does, the firm may still be eligible for consideration where their Tender Submission is supported by a Parent Company Guarantee.

Should after review of the financial evaluation the tenderer fail, then the tender submission will be rejected.

Minimum level(s) of standards required:

With reference to SPD Q4B; It is a requirement of this contract that bidders hold, or can commit to obtain prior to the commencement of any subsequently awarded contract, the types and levels of insurance indicated below.

Employer’s Liability Insurance = 10m GBP

Public Liability Insurance = 5m GBP

Professional Indemnity Insurance = 2m GBP

Medical Malpractice = 5m GBP

III.1.3) Technical and professional ability

List and brief description of selection criteria:

With reference to SPD Q4C.1.2; The Bidder must provide two (2) examples from the last five years that demonstrate relevant experience in delivering community-based support to forensic service users. The examples should evidence support provided to individuals who have been involved with the criminal justice system and who may also have mental health conditions, learning and/or physical disabilities, substance misuse issues, and a history of offending behaviour.

The examples should demonstrate how the support provided has enabled individuals to successfully reintegrate into the community, promote recovery and rehabilitation, and support desistance from offending behaviour. They should also evidence the implementation of effective risk management strategies, partnership working, and measures to promote community safety while supporting positive outcomes for the individual.

For each example, Bidders must provide the following information:

1.A brief description of the service and support provided, including the setting and the individual's support needs.

2. The nature and complexity of the behaviours that challenge, including any factors contributing to the behaviours and the impact on the individual and others.

3. The assessed risks presented to the individual and/or others, including any risks associated with offending behaviour, mental health, substance misuse, vulnerability, or community safety.

4. The approach taken to support the individual, including the use of Positive Behaviour Support (PBS) or other evidence-based, person-centred approaches to assessment, intervention, and risk reduction.

5. Multi-agency working arrangements, including how the service collaborated with Justice Services, health professionals, housing providers, social work, and other relevant agencies. This should include details of the development, implementation, and review of risk management plans and public protection arrangements where applicable.

6. The experience, qualifications, and training of staff involved in delivering the support, including forensic services, risk management, trauma-informed practice, Positive Behaviour Support, mental health, substance misuse, and offending behaviour.

7. The outcomes achieved for the individual, including evidence of:

- Meeting assessed care and support needs;

- Successful reintegration into the community;

- Promotion of recovery and rehabilitation;

- Progress towards desistance from offending behaviour;

- Effective risk management and enhanced community safety;

- Reduction in restrictive practices, where applicable;

- Improved quality of life, wellbeing, and independence;

- Increased community participation, social inclusion, and other measurable positive outcomes.

Responses will be assessed on a Pass/Fail basis.

PASS

The Bidder provides two satisfactory, relevant examples that collectively demonstrate substantial experience and capability in supporting forensic service users who present behaviours that challenge. The examples include all information requested and provide sufficient evidence of effective support, risk management, multi-agency working, rehabilitation, recovery, and community reintegration.

FAIL

The Bidder fails to provide two satisfactory and relevant examples or omits material information to the extent that their experience, capability, and ability to deliver the required service cannot be adequately assessed.

Minimum level(s) of standards required:

The Tenderer must be have a dual registration with the Care Inspectorate as both a Care at Home Service and a Housing Support Service at the date of tender submission. The Tenderer must also hold current Care Inspectorate inspection grades of 3 (Adequate) or above for each registered service.

The Tenderer confirms that all staff directly providing care and support to service users are, where required by legislation, registered with the Scottish Social Services Council (SSSC), or will be registered within the statutory timescales.
