Section IV: Procedure
IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The procurement falls outside the scope of application of the Directive
Explanation
The award of this contract without prior publication in the Official Journal of the European Union (OJEU) is considered lawful under the provisions of Directive 2014/24/EU, specifically where the use of a negotiated procedure without prior publication is justified.
In this case, the contract is a call-off awarded under an existing, compliant framework agreement that was itself procured in accordance with the Directive. Framework agreements allow contracting authorities to award specific contracts (call-offs) without further publication, provided the terms of the framework are adhered to.
Additionally, the urgency associated with maintaining uninterrupted postal services particularly for critical clinical correspondence supports the need for a timely award. Delays arising from a full procurement process could have resulted in service disruption, impacting patient care and operational continuity.
Furthermore, Royal Mail Group Limited is the UK’s designated Universal Postal Service Provider and is uniquely positioned to provide nationwide collection and delivery of letters.
Therefore, the award complies with procurement regulations as it is both framework-based and proportionate to the circumstances, ensuring continuity of essential services.
