Management of the Council"s sports and leisure facility portfolio which includes the following;
— Bexhill Leisure Pool;
— Bexhill Leisure Centre;
— Rye Sports Centre.
The Council is currently reviewing the options for the future of a new Leisure Centre in Bexhill and for this reason the proposed arrangement will be for 30 months with an optional extension of a further 30 months at both Bexhill sites. The contract period for Rye Sports Centre will be 10 years with an optional extension of a further 10 years.

Total quantity or scopeGeneral scope is outlined in the short description (II.1.5). The estimated contract value over the contract period for Lot 1 (Bexhill Leisure Pool and Bexhill Leisure Centre) is 930 000 GBP exc. VAT over the maximum period of 60 months. The estimated contract value over the contract period for Lot 2 (Rye Sports Centre) is 3 720 000 GBP exc. VAT over the maximum period of 20 years.
The Council will award both lots to 1 operator and the arrangement will not be split into 2.
The Council will award to the operator a service concession to operate the centres, with a right to exploit the services to be delivered at the centres and retain any payment which is received from third party users. The Council will grant to the operator leases to all three centres to enable it to deliver the services under this arrangement. |

In order to participate in the tender you must register as a supplier and express an interest in the opportunity.
Those invited to tender will be evaluated on the basis of the relevant EU public procurement directives and United Kingdom regulations as regards their financial standing, their technical capacity and ability, and other permitted grounds as well as the qualitative and commercial offering in line with the award criteria detailed in the Invitation to Tender.
The East Sussex Procurement Hub is a shared service hosted by Wealden District Council, requests for information and to participate will be handled by the East Sussex Procurement Hub on behalf of Rother District Council.

Lodging of appeals
Rother District Council will incorporate a minimum 10 calendar days standstill at the point information on the decision to award the contract is communicated to tenderers. This decision notice will incorporate the award criteria, the reasons for the decision, the reasons (if any) why a tenderer did not meet any technical specification, the identity of the successful tenderer(s) and a precise statement of when the standstill period is expected to end. Any appeal or challenge against the award decision must be communicated to the address stated within the standstill period. If an appeal or challenge regarding the decision to award the contract has not been successfully resolved the Public Contracts Regulations 2015) provide for aggrieved parties who have suffered harm or are at risk of harm by a breach of the procurement rules to take action in the High Court (England Wales and Northern Ireland). Any such action must be brought within 3 months (NB this time limit may be reduced to 30 days in circumstances where the contract award has been publicised to all participants in accordance with the Regulations). Where a legal challenge is launched against the award decision Rother District Council is obliged to suspend the making of the contract. Where a challenge is made after the contract has been entered into then that contract could be declared ineffective and/or shortened and/or a fine imposed by the court, but only where the court are satisfied that there has been a serious breach of the procurement rules.
