Short description of the contract or purchase(s)

Nuclear, Biological, Chemical and Radiological protection equipment. The Authority is seeking to procure a range of worldwide, rapidly deployable, self-sufficient, modular chemical/biological/radiological protected capture, containment and transport systems for the hazard management of contaminated liquid waste. The 5 year contract shall be for the provision of equipment, on-going supply of spares and consumables, technical documentation, Train-the-Trainer (T3M) and Train-the-Trainer-Maintainer (T3M) packages. The procurement will include provision of DSAT compliant training, safety notice and NATO codification of all items.

Quantity or Scope of the Contract

II.2.1)

Total quantity or scope

The system(s) will be capable of capturing run-off from vehicle liquid decontamination systems, transferring the captured contaminated liquid to a suitable containment solution for transportation. Additionally, the transfer solution will be capable of transferring contaminated liquid from other capture systems; both open access and pillow tank type. For classification purposes a system with vehicle bunding, transfer and containment will be referred to as ‘Full’ and without vehicle bunding as ‘Light’. The solution will be capable of safely containing contaminated liquid for up to 90 days in CO to A1 environments.

The Contract shall be for a period of 5 years for the provision of equipment, on-going supply of spares and consumables, technical documentation, Train-the-Trainer (T3M) and Train-the-Trainer-Maintainer (T3M) packages. The procurement will include provision of DSAT compliant training, safety notice and NATO codification of all items. The initial purchase is estimated at 10 Full and 8 Light systems, however specific quantities are subject to change and will be confirmed to down-selected Tenderers in the Invitation to Tender (ITT). Delivery shall be no later than 31.5.2018. The Authority reserves the right to procure additional quantities from the successful supplier.

The requirement includes:

Provision of information related to the safe use and environmental impact of the system.

Development of Training activity with the Authority to produce an enduring training solution which is compliant with the Defence Systems Approach to Training (DSAT).

Provision of DSAT compliant User Technical Documentation.

Development and provision of packaging recommendations for handling, storage and transportation of the MIZZY Liquid system.

Responsibility for all deliverables under the contract to be labelled, packaged in accordance with Def Stan 81-41.

Responsibility for all deliverables under the contract are able to be handled in accordance with Health and Safety Executive (HSE) regulations and Def Stan 00-250.

Acting as the Design Authority (DA) for the MIZZY Liquid system and hold technical information in a Logistic Information Repository (LIR).

Provision of information related to system or component changes.

Responsibility for all items within the MIZZY Liquid system required for operation are disposable in accordance with current legislation and policy.

The full System Requirements will be released at the ITT stage to down-selected suppliers.

III.1)

Conditions Relating to the Contract

III.1.1)

Deposits and guarantees required

The Authority reserves the right to require an indemnity, guarantee or bank bond if the supplier does not meet the required standard for economic and financial standing.

III.1.2)

Payment will follow delivery and acceptance of the goods, works or services.

If a group of economic operators submits a bid, the group must nominate a lead organisation to deal with the Authority. The Authority shall require the group to form a legal entity before entering into the contract.

Other particular conditions to which the performance of the contract is subject

The Authority reserves the right to incorporate a Security Aspects letter into the contract, in addition to other security-related Terms and Conditions. The Authority reserves the right to amend any condition related to security of information to reflect any changes to national law or government policy. If any contract documents are accompanied by a Security Aspects letter, the Authority reserves the right to amend the terms of the Security Aspects letter to reflect any changes in national law or government policy whether in respect of the applicable protective marking scheme, specific protective markings given, the aspects to which any protective marking applies or otherwise.

The Authority will apply all the offences listed in Article 39(1) of Directive 2009/81/EC of the European Parliament and of the Council (implemented as Regulation 23(1) of the Defence and Security Public Contract Regulations (DSPCR) 2011 in the UK) and all of the professional misconducts listed at Article 39(2) of Directive 2009/81/EC of the European Parliament and of the Council (see also Regulation 23(2) in the DSPCR 2011) to the decision of whether a Candidate is eligible to be invited to tender.

Candidates will be required to sign a declaration confirming whether they do or do not have any of the listed criteria as part of the pre-qualification process.

III.2.2)

Economic and financial standing



(b) The presentation of balance-sheets or extracts from the balance-sheets, where publication of the balance-sheet is required under the law of the country in which the economic operator is established.

(c) Where appropriate, a statement, covering the three previous financial years of the economic operator, of: (i) the overall turnover of the business of the economic operator; and (ii) where appropriate, the turnover in respect of the work, works, goods or services which are of a similar type to the subject matter of the contract.

At least 2 years audited accounts (if available) or equivalent must be submitted as part of the Pre-Qualification Questionnaire response. The Authority reserves the right to request further financial information following receipt of the Pre-Qualification Questionnaire response.



Financial assessment will be undertaken on the supplier's financial status. An overall pass / fail judgement will be made after considering areas such as turnover, profit, net assets, liquidity, gearing and capacity. This assessment will include the Parent company where applicable. An independent financial assessment obtained from a reputable credit rating organisation may be utilised as part of this process.







III.2.3)

Technical and/or professional capacity



(a) in the case of a supply contract requiring the siting or installation of goods, a services contract or a works contract, the economic operator's technical ability, taking into account in particular that economic operator's skills, efficiency, experience and reliability;

(c) a statement of the principal goods sold or services provided by the supplier or the services provider in the past five years, or during a shorter period if necessary, and: (i) the dates on which the goods were sold or the services provided; (ii) the consideration received; (iii) the identity of the person to whom the goods were sold or the service were provided; (iv) any certificate issued or countersigned by that person confirming the details of the contract for those goods sold or services provided; and (v) where (a) that person was not a contracting authority, and (b) the certificate referred to in sub-paragraph (c) (iv) is not available, any declaration by the economic operator attesting the details of the goods sold or services provided;

(d) a statement of the technicians or technical services available to the economic operator to: (i) carry out the work under the contract, or (ii) be involved in the production of goods or the provision of services under the contract, particularly those responsible for quality control, whether or not they are independent of the economic operator;

(e) a statement of the economic operator's: (i) technical facilities; (ii) measures for ensuring quality; (iii) study and research facilities; and (iv) internal rules regarding intellectual property;

(f) a check carried out by the contracting authority or on its behalf by a competent official body of the member State in which the economic operator is established: (i) on the technical capacity of the economic operator; and (ii) if relevant, on the economic operator's study and research facilities and quality control measures;

(h) the environmental management measures, that the economic operator is able to apply when performing the contract, but only where it is necessary for the performance of that contract;

(j) a description of the tools, material, technical equipment, staff numbers, know-how and sources of supply (with an indication of their geographical location when it is outside the territory of the EU) available to the economic operator to perform the contract, cope with any additional needs required by the contracting authority as a result of a crisis or carry out the maintenance, modernisation or adaptation of the goods covered by the contract;

(k) any samples, descriptions and photographs of the goods to be purchased or hired under the contract and certification of the authenticity of such samples, descriptions or photographs;

(l) certification by official quality control institutes or agencies of recognised competence, attesting that the goods to be purchased or hired under the contract conform to standards and technical specifications (within the meaning of regulation 12(1)) identified by the contracting authority;

(n) a certificate: (i) attesting conformity to quality management systems standards based on the relevant European standard; and (ii) from an independent accredited body established in any member State conforming to the European standards concerning accreditation and certification;

(o) any other evidence of conformity to quality management systems standards which are equivalent to the standards referred to in sub-paragraph (n) (i).

As requested at the a) Pre-Qualification Questionnaire stage and b) Invitation to Tender (ITT) stage for those companies down-selected to participate in the ITT stage.

Objective criteria for choosing the limited number of candidates

Interested suppliers are required to complete the Pre-Qualification Questionnaire (PQQ) to provide information that allows the Authority to evaluate the supplier's capacities and capabilities against the selection criteria set out at Sections III.2.1), III.2.2) and III.2.3) of this Contract Notice.

The Authority will use the PQQ response to create a short-list of tenderers who:

(1) are eligible to participate under Section III.2.1) of this Contract Notice;

(2) fulfil any minimum standards under Sections III.2.2) and III.2.3) of this Contract Notice; and

(3) best meet in terms of capacity and capability the selection criteria set out in Sections III.2.2) and III.2.3) of this Contract Notice.

Additionally, prospective suppliers who score a 0 or a 1 against any of the Project Questions in Section 6 of the PQQ will not be invited to tender.
