Ship Acquisition, which is part of the UK Ministry of Defence (MOD), proposes to place a contract with Aerius Marine GmbH (Company Registration Number I8566) (‘the Company’) for Initial Provisioning Spares for the High Ventilation and Air Conditioning (HVAC) systems (‘the Systems’), which have been manufactured and installed by the Company on the Queen Elizabeth Class (QEC) Aircraft Carriers.
The Contract covers the supply of components for (‘the Systems’) comprising the following: Auto-Flame Protection Screen, Flashproof-Screen, Motor For Radial Fan, Flat Filter Cells, V-Belt SPA Profile (‘the Goods’). The contract has an estimated value of 1 600 000 GBP (One million and six hundred thousand pounds) and a duration of 2 (two) years.

Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation:
Ship Acquisition, which is part of the UK Ministry of Defence (MOD), proposes to place a contract with Aerius Marine GmbH (Company Registration Number I8566) (‘the Company’) for Initial Provisioning Spares for the High Ventilation and Air Conditioning (HVAC) systems (‘the Systems’), which have been manufactured and installed by the Company on the Queen Elizabeth Class (QEC) Aircraft Carriers.
The Contract covers the supply of components for (‘the Systems’) comprising the following: Auto-Flame Protection Screen, Flashproof-Screen, Motor For Radial Fan, Flat Filter Cells, V-Belt SPA Profile (‘the Goods’). The contract has an estimated value of 1 600 000 GBP (One million and six hundred thousand pounds) and a duration of 2 (two) years.
The Systems are subject to on-going design iterations. If the spares were procured from another manufacturer they would have different technical characteristics and, due to the continuing evolution of the Systems, could place the safety of the crews and equipment at risk and would undermine system acceptance. It is therefore considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011) for technical reasons.
