IV.1.1) Type of procedure

Negotiated procedure without publication of a contract notice

Justification for selected award procedure:

The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons

Explanation:

Ship Acquisition, which is part of the UK Ministry of Defence (“the Authority”), proposes to place a 2 year contract with an estimated contract value of 9 600 000 GBP with Rolls Royce Power Engineering Plc (company number: 01003142) (the “Company”) for the procurement of an MT30 Gas Turbine Engine and its transport stands and hard blanks, manufactured by the Company and installed on the Queen Elizabeth (QE) Class Aircraft Carriers. The components include the various sub-assembly components that make up the equipment, including the MT30 engine, ISO storage container, transport stands, T26 conversion kit and instructions for the conversion of the engine from QEC to T26.

It is considered that this contract can be placed using the Negotiated Procedure without Prior Publication of a Contract Notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011) for technical reasons. This is because the Company is the Original Equipment Manufacturer of the equipment, the Ship Technical Specification requires these component spares to meet the specifications for the equipment manufactured by the Company and only the Company has access to the specific technical knowhow and technical design and manufacturing data required to manufacture these specialised component spares for the equipment.

It is also considered that the Negotiated procedure can be used for technical operability reasons. This is because to procure the Goods from a manufacturer other than the Company would oblige the MOD to acquire goods having different technical characteristics, which would therefore be incompatible with the existing goods and also result in disproportionate technical difficulties in operating and maintaining the Goods.
