Justification for selected award procedure:
New works/services, constituting a repetition of existing works/services and ordered in accordance with the strict conditions stated in the Directive
Explanation
The Council has complied with the conditions stated in the directive as follows.
The Public Contracts Regulations 2015 state in Reg 32
9) The negotiated procedure without prior publication may be used for new works and services consisting of the repetition of similar works or services entrusted to the economic operator to which the same Contracting Authority awarded an original contract, provided that such works or services are in conformity with a basic project for which the original contract was awarded following a procedure in accordance with regulation 26(1) and (2);
10) The basic project shall indicate the extent of possible additional works or services and the conditions under which they will be awarded;
11) As soon as the first project is put up for tender, the possible use of this procedure shall be disclosed and the total estimated cost of subsequent works or services shall be taken into
Consideration by the Contracting Authority when it applies regulation 5.
The initial tender which complied with regulation 26(1) and (2) included the following information:
at this stage of our transformation journey Walsall Council is not yet able to specify the specific types of additional services that may be required beyond the initial transformation Phase 1: Diagnostics, Programme and Business Case Contract ‘Phase 1 Contract’. It is anticipated that the outputs of the initial Transformation Phase 1 Contract may be used to inform the scope and scale of a further Transformation Phase 2:
Transformation delivery contract ‘Phase 2 Contract’. Subject to satisfactory delivery of Phase 1 contract and further approval, Walsall Council may enter in to a Phase 2 contract, with the successful bidder for the Phase 1 contract. Due to the interdependencies, likely commercial sensitivity and exclusivity associated with the Phase 1 contract and a Phase 2 contract, in the event that Walsall Council decides to award a Phase 2 contract, it is anticipated that the Phase 2 contract will be awarded in accordance with Public Contract Regulations 2015,
Regulation 32 ‘Use of the negotiated procedure without prior publication’, Paras (9), (10) and (11). The specific details of a Phase 2 contract would be subject to future negotiation, the mutual agreement of Walsall Council and the successful bidder.
