Abstract

Swansea Council has been awarded National Lottery Heritage Fund grant funding to undertake the undertake the shell and core re-development works at the Hafod Copperworks Site, specifically the refurbishment of the Grade II Listed Powerhouse building, new build visitor centre, link structure and modification to 25% of the Grade II Listed Rolling Mill as a barrel store for Penderyn Whisky as the long term end tenant. In addition, shell and core refurbishment works will also be required to the Outbuildings following the successful Welsh Government grant award secured by Swansea Council. II.2.4) Description of the procurement

Swansea Council has secured National Lottery Heritage Funding (NLHF) to re-develop the Grade II Listed Hafod-Morfa Powerhouse, reconfigure 25% of the existing Rolling Mill (Collection Store) and provide a new build visitor centre, and walkway connecting the visitor centre to the rolling mill. In addition, shell and core refurbishment works will also be required to the outbuildings, specifically the Morfa Gates, Porters Lodge and Weighbridge Office following the successful Welsh Government grant award secured by Swansea Council.

The site is owned by Swansea Council and more widely consists of 12.5 acres containing 12 Grade II listed buildings and features. This represents the greatest concentration of physical remains of the copper works that formerly dominated the Lower Swansea Valley; and one of the greatest concentrations of industrial archaeology outside Coalbrookdale. The site’s smelting works and other buildings once dominated the Lower Swansea Valley and shaped its development as an industrial town with global connections. Since its closure in 1980 the site fell into dereliction. A previous Cadw Heritage Grant has put in place trails, interpretation and cleared undergrowth as the first phase of a heritage led regeneration of the site. The area is one of the most important sites of the industrial revolution in Britain, a site that exerted a profound influence on the world economy.

Swansea Council along with its appointed Design Team will be seeking a suitably experienced Principal Contractor, specifically of Heritage Buildings to undertake the sensitive shell and core restoration, and new build elements as a result of the NLHF and Welsh Government funding.

The end tenant of the Powerhouse Re-development scheme, Penderyn Whisky will be leading the internal fit out works to deliver an operational distillery and visitor centre attraction as a separate package of works following completion of the shell and core works.

No end tenant has been identified for the outbuildings buildings at this moment in time, however Swansea Council continues to seek such interest.

Some stabilisation works to other structures not undergoing redevelopment works at this stage in close proximity to the Powerhouse building will also be required.

Precise information on deadline(s) for review procedures:

The Council will incorporate a minimum 10 calendar day standstill period at the point information on the award of the contract is communicated to tenderers. This period will extend to 15 calendar days for communication by non-electronic means. Applicants who are unsuccessful shall be informed by the Council as soon as possible after the decision has been made. Should additional information be required it should be requested of the addressee in section I.1). If an appeal regarding the award of the contract has not been successfully resolved, The Public Contracts Regulations 2015 provide for aggrieved parties who have been harmed or are at risk of harm by breach of the rules to take action in the High Court (England, Wales, and Northern Ireland). Any such action must be brought promptly (generally within 30 days). Where a contract has not been entered into, the Court may order the setting aside of the award decision or order the Council to amend any document and may award damages. If the contract has been entered into the Court may, depending on the circumstances, award damages, make a declaration of ineffectiveness, order the Council to pay a civil financial penalty, and/or order that the duration of the contract be shortened. If a declaration of ineffectiveness is sought, any such action must be brought within 30 days where the Council has communicated the award of the contract and a summary of reasons to tenderers, or otherwise within 6 months. The purpose of the standstill period referred to above is to allow the parties to apply to the Courts to set aside the award decision before the contract is entered into.

The Council was previously of the view to not award any further extension of time to the already extended tender period to maintain programme. However, the Council has received further requests for extension of time necessitated by the practical difficulties of completing tenders over the summer months. Accordingly the Council and the Project Team has reviewed its position and is prepared to award a further 3 weeks extension of time for submission of all tenders. The closing date for all tender submissions is now Friday, 30th August at 12 noon.
