Section IV: Procedure
IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
Extreme urgency brought about by events unforeseeable for the contracting authority and in accordance with the strict conditions stated in the Directive
Explanation
Due to the Covid-19 emergency Royal Borough of Greenwich (RBG) was unable to complete its market and user consultation process and had run out of time to plan and execute a full procurement process. Also due to the emergency key RBG officers were diverted to front line operations to support key services within the borough which contributed to loss of resource to devote time in the development of the service specification. The contract will be for a 3-year period which is the minimum term acceptable to the supplier and provides the immediate use of a home working solution to members of staff on the Contact Centre (daytime and out of hours).
The provisions of Regulation 99 of the PCR 2015, provides for Grounds of Ineffectiveness — This direct award will be lawful and the first ground does not apply because all the following apply:
(a) that RBG considered the award of the contract without prior publication of a contract notice to be permitted by part 2;
(b) that RBG has had published in the official journal a voluntary transparency notice expressing its intention to enter into a contract;
(c) the contract has not been entered into before the end of a period of at least 10 days beginning with the day after the date on which the Voluntary Transparency Notice (VEAT) was published.
