The agreement includes the waiver of historic fees due for any institutions who have used Oracle Java since 2023.

Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation
Institutions that use Oracle Java SE are required to purchase subscriptions. Following consultations with the HE and FE sectors, institutions have instructed Jisc to purchase Oracle Java SE Universal Subscriptions (collectively) based on the applicable procurement relationship. In this case it is not possible to competitively tender this requirement on behalf of our members and would not be in the public interest, both in terms of cost associated and the significant operational risks associated with changing suppliers. Oracle Corporation has sole technical rights to their products, and the waiver of historic fees as mentioned in the description cannot be provided by any other than Oracle.
No alternative route is possible other than direct negotiation with and award to Oracle itself. Jisc therefore relies on Regulation 32.2b (ii) of PCR2015, because the use of Oracle Java is necessary and there is no competition for technical reasons. There is no reasonable alternative or substitute approach available at this time.
Jisc Services Limited observed, without challenge, a 30 day standstill period.
