Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: protection of exclusive rights, including intellectual property rights
Explanation
The contract has been awarded via a compliant call-off under an established framework agreement that was procured in accordance with the Public Contracts Regulations 2015 following a competitive process. The framework sets out the terms governing the award of call-off contracts, and no further competition or advertisement is required.
The selected supplier is the provider of a proprietary software system (Q-Pulse), and holds the necessary intellectual property rights to supply, support and maintain the system. As such, the contract can only be awarded to this supplier.
The award is therefore compliant with Regulation 33 of the Public Contracts Regulations 2015 and the relevant provisions of Directive 2014/24/EU, and no prior publication of a call for competition is required.
