Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: protection of exclusive rights, including intellectual property rights
Explanation
The contract has been awarded via a compliant call-off under an established framework agreement that was procured in accordance with the Public Contracts Regulations 2015 following a competitive process and advertised in line with the requirements of Directive 2014/24/EU. The framework sets out the terms governing the award of call-off contracts, and as such no further competition or prior publication is required for individual awards made in accordance with those terms.
The selected supplier is the provider of a proprietary software system (Q-Pulse) and holds the necessary intellectual property rights to supply, support and maintain the system. Consequently, the contract can only be performed by this supplier. The award has therefore been made in line with the framework provisions and the principles of transparency, equal treatment and non-discrimination.
Accordingly, the award is compliant with Regulation 33 of the Public Contracts Regulations 2015 and the relevant provisions of Directive 2014/24/EU, and the use of a procedure without prior publication is justified.
