The procurement falls outside the scope of application of the Directive
Explanation
Procurement was carried out via a call-off under the Fusion 21 Building Safety and Compliance Framework, Lot 6 - Fire Risk Assessments. The framework was established through a compliant OJEU/Find a Tender advertised process and allows contracting authorities to award contracts through mini-competition without further prior publication. The contracting authority accessed an existing framework agreement and ran a mini-competition among pre-approved suppliers. This approach is permitted under the Public Contracts Regulations 2015, which allow contracts to be awarded without a new call for competition where a compliant framework agreement is used. The process ensured transparency, equal treatment of suppliers on the framework, and compliance with applicable procurement law.
