All Early Learning and Childcare (ELC) providers must meet the Scottish Government’s Funding Follows the Child and the National Standard for Early Learning and Childcare Providers in order to access public funding for the delivery of funded ELC hours.
This applies across all sectors (public, private, third sector and childminders) and requires providers to evidence compliance with the National Standard criteria, as set out in Scottish Government guidance and associated operating frameworks.

III.2.2) Contract performance conditions
The following mandatory conditions must be met as part of contract performance:
The Service Provider must demonstrate ongoing compliance with the Scottish Government’s Funding Follows the Child and the National Standard for Early Learning and Childcare Providers, including achieving and maintaining Care Inspectorate evaluations of “good” or above across relevant quality themes.
The Service Provider must be registered with the Care Inspectorate as a Day Care of Children Service or Childminding Service and maintain this registration for the duration of the contract.

Community benefits requirements have not been included due to the nature of the services being procured.
The framework relates to the delivery of funded Early Learning and Childcare by a diverse range of providers, including small and medium-sized enterprises and childminders, operating across the public, private and third sectors.
Imposing additional community benefit obligations within this context is not considered proportionate and may create an unnecessary administrative burden on providers, potentially impacting accessibility to the framework.
The primary purpose of this framework is to deliver statutory funded early learning and childcare hours for eligible children. This service, in itself, delivers significant social and economic benefits to the local community, including supporting children’s development and enabling parental participation in employment, education and training.
