Short description of the contract or purchase(s)
This notice relates to an amendment to the Service Delivery Agreement entered into on 17.2.2012 (following a competitive award process in accordance with the Public Contracts Regulations 2006). The amendment is necessary to take account of the fact that the Police and Crime Commissioners and Chief Constables of Leicestershire Police, Nottinghamshire Police and Northamptonshire Police (the ‘Collaborating Forces’), all of which have replaced bodies listed in the original OJEU Notice, have decided to enter into a collaboration agreement with the Police and Crime Commissioner and Chief Constable of Lincolnshire Police to establish a shared ICT platform using NICHE technology and the services of a data centre supplied to the Police and Crime Commissioner for Lincolnshire under the SDA. The Collaborating Forces will not be parties to the amended SDA and no contractual relationship will exist between the Collaborating Forces (either individually or collectively) and G4S Care and Justice Services (UK) Limited (or any other private sector entity) as a result of this transaction. The amendment to the SDA will be validly made and represents changes which are within the scope of the changes permitted under the original contract. The amended SDA will not amount to a new contract which requires a new competition to be held under the Public Contracts Regulations 2015. The collaboration agreement is to be entered into under section 22 of the Police Act 1996. This collaboration agreement does not require a competition under the Public Contracts Regulations 2015 because it implements co-operation between the four police forces in the public interest and meets the requirements of regulation 12(7) of the Public Contracts Regulations 2015.
