Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation
Within England and Wales, the Procurement Directives are implemented into law through the Public Contracts Regulations 2015 (as amended) Regulation 32 (2)(b)(ii) of the Public Contracts.
Regulations 2015 allows for award without prior Publication through the Negotiated Procedure where competition is absent for “technical reasons” and the contract has been awarded on this basis.
The requirement is an upgrade of an Amplifier System that was purchased in 2.2017:
— being an upgrade of an existing system the knowledge required is held by the company that provided the original equipment, Amplitude,
— the original tender enquiry received a single bid therefore supporting the case that no other options are available in the market.
Searches of the market were carried out using various platforms and tools without success in finding another potential supplier.
Competition is therefore absent for technical reasons.
