Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation
Para 32 (5b) sets out that “a negotiated procedure without prior publication may be used for public supply contracts for additional deliveries by the original supplier which are intended either as a partial replacement of supplies or installations or as the extension of existing supplies or installations where a change of supplier would oblige the Contracting Authority to acquire supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance”.
The licences purchased are covered by an existing OMA between the CPS and Oracle, which expires in June 2020. Support and maintenance for these licences is considered to be additional deliveries by Oracle to the CPS which is an extension of existing supplies. Considering this, and that Oracle is the only provider within the open market who is able to provide support for Oracle licences, a procurement through either a framework or competitive process has been ruled unnecessary.
