The works, supplies or services can be provided only by a particular economic operator for the following reason: absence of competition for technical reasons
Explanation
As per Reg 32.2(b)(iii) — Telent has exclusive rights to carry out the software security upgrade to the MODAS server infrastructure currently used by NIFRS as this supplier holds the intellectual property rights and source code and therefore is the only supplier that can provide this upgrade.
