Section IV: Procedure
IV.1) Description
IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition
Justification for selected award procedure:
The works, supplies or services can be provided only by a particular economic operator for the following reason: protection of exclusive rights, including intellectual property rights
Explanation
DVA is currently undergoing a process of business transformation. One element of the programme, infrastructure, will seek to completely rebuild and refurbish the test centre network, including the testing equipment. There is a legislative requirement for DVA to continue to deliver vehicle testing services throughout the period of transformation. This provision needs to be seamless, complete and without interruption until all sites transition to the new contractual arrangements. It therefore remains essential that a vehicle testing support and maintenance contract continues to provide services until 2024, at minimum. The PCR 2015 permit derogations towards a contract to a single supplier where competition is absent for technical reasons Reg 32. (2)( b)(ii) refers and (iii) the protection of exclusive rights, including intellectual property rights, but only where no reasonable alternative or substitute exists. It may be possible to rely on this derogation due to the specialist nature of the testing equipment and maintenance and given that the incumbent is the only organisation who could support the software system which is integral to the vehicle testing equipment and environment and for which the incumbent owns IPR.
