IV.1) Description

IV.1.1) Type of procedure

Award of a contract without prior publication of a call for competition

Justification for selected award procedure:

The procurement falls outside the scope of application of the Directive

Explanation:

The Health Board currently own a fleet of Heart and Lung and ATS equipment which are now over 6 to 7 years old. The Health Board requires specialist maintenance support for this equipment to ensure the equipment is operating at peak efficiency as the Heart and Lung devices for example pumps and oxygenates the blood during open heart surgery. Therefore, specialist support is required to ensure and protect patient safety and Livanova are the only company that can provide this specialist maintenance support and repair requirement.

The contract will be for two years with an option to extend for a further one year in anticipation of a replacement programme of this equipment after 10 years of life expectancy.

In addition, there are a small number of consumables which currently sit on an All Wales contract which expires at the end of 2021 and are the only compatible products available for this equipment. The Health Board, therefore, reserves the right to include these consumables if required at any point of the contract and an estimated value has been included in the overall contract total which may never be fully utilised.

Based on the specialist maintenance support required, the Health Board is applying a 10 day standstill period prior to awarding this contract.
